If you do not agree with our policies and practices, your choice is not to use our Website or App. By accessing or using the Website or App, you agree to this Privacy Policy. Individuals Under the Age of 21

Our Website and App are not intended for anyone under 21 years of age. No one under age twenty-one may provide any information to or on the Website or App. We do not knowingly collect personal information from individuals under 21. If you are under 21, do not use or provide any information on the Website or App including any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under 21, we will delete that information. Pages of our Website, App, and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us. 

We may transmit information between the Website and the App to provide a seamless experience, ensure consistent account functionality, personalization, and synchronization. Any data transfers will adhere to our privacy and security measures and with this Privacy Policy.

How Are Customer Accounts Managed? 

Customer profiles and loyalty data are managed through our Point-of-Sale (POS) system, Greenbits. When you provide your phone number in-store, it is used to create or update your loyalty account in our POS system. The app may display this information for your convenience but does not store it locally or transmit it externally.

App Tracking Transparency (ATT)

In accordance with Apple’s App Tracking Transparency (ATT) framework, we request your permission before collecting data that may be used to track your activity across apps and websites owned by other companies.

When launching the app, you may see a prompt asking if you allow tracking. If you choose not to allow it, we will respect your decision and will not collect tracking identifiers such as the IDFA (Identifier for Advertisers).

You can change your tracking preference at any time by going to: Settings > Privacy & Security > Tracking, then adjusting permissions for the American Mary app.

We use this data (if granted) solely to improve the App experience through performance metrics and general usage analytics.

Third-Party Use of Cookies and Other Tracking Technologies

The App and/or Website integrates with the following services:

  • Dutchie or other 3rd Party: for displaying our live ecommerce menu
  • Greenbits API: to show loyalty balances linked to your phone number
  • WordPress API: to display store updates, promotions, and events
  • Google Analytics: for tracking general app usage and behavior. This data may include anonymized device information and session data. With your permission, Google Analytics may use your device’s Identifier for Advertisers (IDFA) for analytics or attribution purposes.

We are committed to ensuring the protection of your privacy not only within our website but also through our vendors and partners. Some content or applications on the Website or App are served by third-parties, including content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties’ tracking technologies or how they may be used, however the data collected by third parties are generally the same types of data disclosed in this Privacy Policy. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. Upon request, we can provide copies of the privacy policies of our vendors and partners.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our App and its contents to you.
  • To provide you with information or services that you request from us.
  • To fulfill any other purpose for which you provide it.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To fulfill the purpose for which you provide it. 
  • For any other purpose disclosed by us when you provide the information.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.  To learn how you can manage your cookie settings, visit the settings page on your browser’s website.  If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly. 
  • Marketing Materials from the Company. If you do not wish to have your email address used by the Company to promote our own or third parties’ products or services, you can opt-out by clicking “Unsubscribe” in an email we send you or at any other time by sending us an email stating your request to info@americanmarywa.com.  If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. 

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Data Security

Other than name and contact information related to your customer profile, and information related to your transaction, which may or may not be associated with your customer profile – information you provide to utilize our 3rd party provider services (i.e. Dutchie ecommerce) is according to that 3rd party vendors privacy policy, which is available through that vendor. 

The safety and security of your information also depends on you. We urge you to be careful about giving out sensitive information in our contact us page, or on any public reply area made available on our Website or the App. The information you share in public areas may be viewed by any user of the Website or App.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or App. Any transmission of personal information through the Website or App is at your own risk. 

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Website home page or through an alert on the App. The date the privacy policy was last revised is identified at the top of the page.
